Rules for use of the Alston CyberMoor System

These rules set out the necessary legal framework that surrounds the use by the public of the Alston CyberMoor System

The Alston CyberMoor System comprises this World Wide Web site and the content and services it provides.

This is the legal framework that regulates use of the Alston CyberMoor System. By using the Alston CyberMoor System, either by logging on this website or by registering as a user you are agreeing to the terms of this framework. It is governed by English law.

Use of the system

Anyone in the Alston Moor community making use of a computer supplied by the CyberMoor project or accessing the CyberMoor community website must use these facilities responsibly and with sensitivity to others. By signing this agreement you and members of your household are making a promise to do this.

In order to access the CyberMoor community website and open a personal web mail account you will need a login name and password. Each member of your household who expects to access the CyberMoor website will be given their own personal login name and password, when they first go to the CyberMoor website. It is every ones' individual responsibility to keep this information secure and private. Do not let anyone else use your login name and password to access the CyberMoor website.

You and members of your household should use e-mail respectfully. Do not send email to any person who does not wish to receive it. If the recipient asks to stop receiving email, you and your household member must stop sending email to that person. Harassment through language, frequency or size of email is prohibited.

Some material on the Internet is protected by copyright, trademark or statutes and laws which protect the creator of that material. Transmission, distribution, or storage of other people's information, data, or material is therefore illegal. If you or members of your household are in any doubt about any material you want to transmit via the CyberMoor website, contact the CyberMoor project and ask.

Alston CyberMoor project reserves the right to remove, at their discretion any material transmitted via the CyberMoor website facilities which could be considered unlawful, defamatory, abusive, threatening, obscene, hateful, could encourage a criminal offence or could otherwise violate local, national or international laws. If you are in any doubt about any material, contact the CyberMoor project and ask.

You and members of your household should not attempt to access restricted information which is not intended for you.

To ensure that the above conditions are complied with, connections to the website will be recorded. If it is suspected that someone is contravening the CyberMoor ' Acceptable use' rules described here, that person's usage of the website will be monitored and if found to be unacceptable to the CyberMoor project, further access to the CyberMoor website will be denied.

For research purposes, records will be kept to identify general patterns of website usage, e.g. number of people using the local information services, number of people logging on per week, etc. Research data will not be kept on any individual's usage of the website.

Registration

If you choose to register as a user then you will be able to access a wider range of content and services on the CyberMoor website. Most of the registration procedure can be accomplished online although certain of the services will require you to provide proof of identity.

Your user name and password will allow you to access the areas of CyberMoor reserved for registered users only.

Content

All material on the CyberMoor (the "Content") belongs to the Body that produced it or their licensors. Copyright 2002.

You may retrieve and display Content from CyberMoor on a computer screen, print individual pages on paper (but not photocopy them) and store such pages in electronic form on (but not on any server or other storage device connected to a network) for your personal, non-commercial use.

Except as expressly set out above, you may not reproduce, modify or in any way commercially exploit any of the Content.

CyberMoor is not responsible for the contents or reliability of the linked websites and does not necessarily endorse the views expressed within them. Listing or inclusion of any linked website shall not be taken as an endorsement of any kind. CyberMoor cannot guarantee that these links will work all of the time and has no control over the availability of linked pages.

Privacy Policy

CyberMoor collects personal information on behalf of the Bodies that provide the system content and services. Each of the Bodies which collects personal information is registered under the Data Protection Act 1998. A full list of the data processing purposes for each of the Bodies can be found at www.dpr.gov.uk.

The information you supply to the Alston CyberMoor project will be kept confidential and secure and used only for the purposes expressly described in this policy.

Alston CyberMoor project will use the personal information you provide to process your application for a computer under the Wired up Communities scheme. Your data will also be used for anonymous statistical analysis by ourselves and by our partners.

The funding bodies will also use your data for monitoring purposes to ensure that our procedures comply with their requirements. Leeds University have been given the job of finding out how things change once people start to use the computers and will need to talk to some of you, with your permission over the next few months. We therefore will be providing information to them to enable them to do this.

To ensure that the Acceptable Use Policy is complied with, connections to the website will be recorded. If it is suspected that someone is contravening the CyberMoor ' Acceptable use' rules that person's usage of the website will be monitored and if found to be unacceptable to the CyberMoor project, further access to the CyberMoor website will be denied.

By applying to the Alston CyberMoor project for a free computer, free Internet access, fast (broadband) Internet access and access to the CyberMoor web site you are signifying your permission for the information you provide to be used in these ways.

In addition, it is possible that either ourselves or our partners, may use the information to let you know of any further programmes which we feel may be of use to you or members of your family. Charges

There is no charge for users to use CyberMoor. However, in common with all internet sites, users will incur telephone charges. Users should be aware that other sites on the Internet may charge people for accessing them.

Use of Community Forums

CyberMoor includes community forums, bulletin boards, discussion groups and other public areas that allow feedback to CyberMoor and interaction between users ("Forums"). CyberMoor may choose whether to control the information/materials posted to Forums by users (the "Messages"), and may delete, move or edit the Messages and/or terminate a user's access to and use of the Forums.

Each user is solely responsible for the content of his or her Messages and must comply with any rules posted on a Forum.

Users may not publish any Messages containing any form of advertising or promotion for goods and services or any chain Messages.

Users may not publish any Messages that are unlawful, threatening, abusive, racist, libellous, indecent, infringe copyright or other rights of third parties or which contain any other form of illegal content or content that conflicts with the equal opportunities or other policies of Eden District Council.

Users may not impersonate any person or claim to represent a body unless they are authorised to do so.

If you wish any Message to be removed from a Forum please contact the system administrator.

Use of EMail

You must not use the EMail service provided by CyberMoor to send, or use or re-use any material which is unlawful, threatening, abusive, libellous or indecent or which infringes copyright or other rights of third parties or which contains any other form of illegal content. You must not use the service to send any chain e-mails or SMS messages or any unsolicited messages.

WARRANTIES AND LIMITS ON LIABILITY

THE ALSTON CYBERMOOR SYSTEM IS A PILOT PROJECT AND THE AGENCIES CONCERNED WITH IT ARE CONSTANTLY WORKING TO IMPROVE IT.

BECAUSE OF THIS AND THE NUMBER OF SOURCES FROM WHICH ALSTON CYBERMOOR OBTAINS CONTENT AND THE NATURE OF ELECTRONIC DISTRIBUTION VIA THE INTERNET, ALSTON CYBERMOOR DOES NOT GIVE ANY WARRANTIES IN RESPECT OF THE SYSTEM, CONTENT, SOFTWARE OR SERVICES AVAILABLE THROUGH THE SYSTEM (COLLECTIVELY, "SERVICES"). IN PARTICULAR, THE SERVICES ARE PROVIDED ON AN "AS IS", "WITH ALL FAULTS" AND "AS AVAILABLE" BASIS. NO INCIDENTAL OR CONSEQUENTIAL DAMAGES

TO THE FULL EXTENT ALLOWED BY APPLICABLE LAW, YOU AGREE THAT ALSTON CYBERMOOR WILL NOT BE LIABLE TO YOU AND/OR ANY THIRD PARTY FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOSS OF PRIVACY OR FOR FAILURE TO MEET ANY DUTY INCLUDING BUT NOT LIMITED TO ANY DUTY OF GOOD FAITH, LACK OF NEGLIGENCE OR OF WORKMANLIKE EFFORT) OR FOR ANY OTHER INDIRECT, SPECIAL, OR PUNITIVE DAMAGES WHATSOEVER THAT ARISE OUT OF OR ARE RELATED TO THE INFORMATION OR SERVICES OR TO ANY BREACH OF THE TERMS BY ALSTON CYBERMOOR, EVEN IF ALSTON CYBERMOOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IN THE EVENT OF FAULT, TORT (INCLUDING NEGLIGENCE) OR STRICT LIABILITY.

THE ALSTON CYBERMOOR SYSTEM CONTAINS LINKS TO OTHER WORLD WIDE WEB SITES PROVIDED BY INDEPENDENT THIRD PARTIES ("THIRD PARTY SITES"), EITHER DIRECTLY OR THROUGH FRAMES, ALSTON CYBERMOOR IS NOT RESPONSIBLE FOR THE AVAILABILITY OR CONTENT OF THIRD PARTY SITES AND WILL NOT BE A PARTY TO, OR IN ANY WAY RESPONSIBLE FOR, ANY TRANSACTION CONCERNING GOODS OR SERVICES AVAILABLE FROM SUCH THIRD PARTY SITES.

NOTWITHSTANDING THIS, ALSTON CYBERMOOR'S LIABILITY WILL NOT BE LIMITED IN THE CASE OF DEATH OR PERSONAL INJURY DIRECTLY CAUSED BY ALSTON CYBERMOOR'S NEGLIGENCE.

Changes to the legal framework of Alston Cyber Moor's System

CyberMoor reserves the right, at its discretion, to make changes to any part of the Alston CyberMoor System and the legal framework that regulates its use. If you use the CyberMoor System after CyberMoor has published changes, you are agreeing now to be bound by those changes. If you do not agree to be bound by those changes, you should not use the Alston CyberMoor System any further.
